This is not a theory. There is no doubt that Oliver P. Roberts was the son of Henry Oliver and Sarah Elizabeth Ferguson Roberts. There is no reported death of an Oliver Roberts so that Brushy Bill/Billy the Kid could assume his identity. Only Brushy Bill claimed that his cousin, Oliver N. Roberts was killed in Oklahoma Territory. The claim that Brushy Bill had a cousin named Oliver N.
